The researcher will identify and summarize the important key historical aspects and inadequacies of “Three Strikes and You’re Out”, as well as the symbolic and cultural dimensions that have prefaced this harsh and inefficient mode of legislation. The researcher will also discuss the “panacea phenomenon” associated with three strikes, and how it has even created the illusion of adjudicatory and correctional progress in California. The researcher will also integrate references to Corrections, Police, and Courts and subtly provide analysis of these core criminal justice components in regard to how they have dealt with “Three Strikes” legislation.
The issues presented are the history and philosophy of “Three Strikes and You’re Out”, the constitutionality of the legislation, and the theoretical feasibility of three strikes. This work will revolve around identifying the elements that must be considered in the “Three Strikes or Not” question.
